Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Leibniz Education Pty Ltd (ABN 18 692 154 162) ("Leibniz," "we," "our," or "us") governing your access to and use of the Leibniz platform and related services (the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you are accepting these Terms on behalf of a school or other organisation, you represent that you have the authority to bind that organisation to these Terms. If you do not agree to these Terms, you may not access or use the Service.

For school pilot deployments, the school's acceptance of a pilot agreement incorporating these Terms constitutes acceptance on behalf of the school's authorised users.


2. Description of Service

Leibniz is an adaptive mathematics learning platform providing personalised practice, AI-assisted grading, and teacher analytics for secondary students. The Service includes the following features:

  • Personalised question selection based on adaptive learning models
  • AI-powered grading for typed and handwritten submissions
  • Progress tracking and teacher reporting dashboards
  • Class management, assignments, and student enrolment
  • Adaptive learning that adjusts to each student's mastery level
  • Hint systems and detailed worked solutions

Features may be added, modified, or retired over time. We will endeavour to provide reasonable notice of material changes to core functionality.


3. User Accounts

3.1 Account Creation and Authentication

Users authenticate via Google or Microsoft single sign-on (SSO), or via email and password. Authentication is managed by a hosted authentication service in Sydney, Australia.

  • School pilot users: Accounts are provisioned via a school-provided email whitelist. When a whitelisted user signs in for the first time, they are automatically assigned a role (student or teacher), linked to their school, and granted Pro access for the pilot period.
  • Teacher access: Teacher roles are granted only to approved, school-provided email addresses. Users cannot self-select or elevate their role.
  • Individual users: May register directly and are assigned the student role.
  • You must provide accurate information and are responsible for maintaining account security.

3.2 Age Requirements and Consent

The Service is designed for secondary school students. The following consent requirements apply:

  • School pilot deployments: The school provides consent for the use of the Service by its students as part of the pilot agreement.
  • Individual users under 18: Parental or guardian consent is required before using the Service.
  • All users: You must be at least 13 years of age to use the Service.

4. Subscription and Payments

4.1 Access Tiers

  • School Pilot — Pro access provisioned by school; no individual payment required
  • Free (registered) — Limited daily questions
  • Pro (individual) — Unlimited access with full features

4.2 Billing

  • Individual Pro subscriptions are billed via Stripe. We never directly handle credit card details.
  • Subscriptions auto-renew unless cancelled before the end of the current billing period.
  • We will provide at least 30 days' notice before any price changes take effect.
  • Refunds are handled on a case-by-case basis.

4.3 Trial Period

Registered users may receive a promotional Pro trial period. Current trial access extends until October 27, 2025. After this date, users will transition to the Free tier unless they upgrade to a paid Pro subscription or are covered by a school pilot agreement.


5. Acceptable Use

You agree NOT to:

  • Share account credentials with others
  • Attempt to circumvent usage limits or security measures
  • Use automated tools to access the Service
  • Copy, redistribute, or sell our content
  • Interfere with other users' access to the Service
  • Use the Service for any illegal purpose
  • Submit inappropriate content through any user input features

5.1 Academic Integrity

You specifically agree NOT to:

  • Share questions or solutions with others during exams or assessments
  • Distribute our content to "question banks" or study groups
  • Screenshot, photograph, or record questions for redistribution
  • Use the Service to complete graded homework or assessments
  • Facilitate academic dishonesty in any form
  • Create derivative works from our questions without permission

5.2 Content Distribution Prohibition

  • Our questions are proprietary educational materials
  • Sharing questions undermines the learning experience for others
  • We actively monitor for unauthorised distribution
  • Violation may result in immediate account termination
  • We may pursue legal action for commercial redistribution

6. Intellectual Property

6.1 Our Content

  • All questions, solutions, and educational materials are our property
  • Content is licensed to you for personal educational use only
  • You may not reproduce or distribute our content without permission
  • Questions are designed to be unique and varied — sharing them damages the educational value for all users

6.2 Your Content

You retain ownership of the answers and work you submit. By using the Service, you grant Leibniz a limited licence to process your responses solely for the following purposes:

  • Providing real-time grading and feedback (stateless — no data is retained by AI providers after processing)
  • Powering adaptive learning and personalised question selection
  • Generating irreversibly anonymised, aggregate statistics (where no individual is identifiable)

Your data is never used to train AI models. AI providers are contractually prohibited from using API data for model training. Each grading request is processed statelessly and independently, with no retention by the AI provider.

Schools may opt out of having their data included in aggregate model tuning by contacting Leibniz at the email address listed in Section 15.


7. Privacy and Data Use

Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference. The following summarises our key data commitments:

7.1 Data Residency and Security

  • All persistent data (user profiles, submissions, grades, enrolments, learning model data, uploaded work) is stored in Sydney, Australia
  • Data is encrypted in transit (TLS 1.2+) and at rest (AES-256)
  • Students are identified internally by pseudonymised UUIDs, not by name or email, in all analytical data

7.2 What We Will Never Do

  • Sell student data to any third party
  • Use student data for advertising or marketing
  • Share identifiable student data with other schools or organisations

7.3 Data Isolation

  • Teachers can only see students enrolled in their own classes
  • Students can only see their own data
  • Students can only join classes belonging to their own school
  • All data access is mediated by authenticated, server-side API routes with role-based authorisation

7.4 Deletion

  • Full deletion is available on request, with comprehensive removal across all related records
  • Production deletion is immediate
  • Encrypted database backups expire automatically after 7 days
  • Server request logs (containing metadata only, not student answers or grades) are retained for 30 days
  • Leibniz may retain irreversibly anonymised, aggregate statistics that contain no identifiable information about any individual, and data required to be retained by law

No student learning data, answers, or grades are sent to any sub-processor other than the AI inference provider (for grading only) and Supabase (primary data store).

7.6 Breach Notification

In the event of a confirmed data breach, affected schools will be notified within 24 hours in accordance with the Notifiable Data Breaches scheme under the Privacy Act 1988.

8. Service Availability

The Service is provided on an "as is" and "as available" basis. While we make reasonable efforts to maintain uninterrupted access, we do not guarantee that the Service will be available at all times.

  • The Service may be temporarily unavailable for scheduled or emergency maintenance
  • At this stage of the platform, no formal uptime SLA is offered
  • We will make reasonable efforts to notify users of planned downtime in advance
  • We do not warrant that the Service will be error-free or that defects will be corrected within a specific timeframe

9. Limitation of Liability

To the maximum extent permitted by applicable law, including the Australian Consumer Law:

  • Leibniz's total aggregate liability arising out of or in connection with these Terms or the Service is limited to the amount you have paid to Leibniz in the 12 months immediately preceding the event giving rise to the claim.
  • Leibniz is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, however caused.

Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy that cannot be excluded, restricted, or modified under the Australian Consumer Law or other applicable legislation.


10. Indemnification

You agree to indemnify, defend, and hold harmless Leibniz, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use or misuse of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or third-party right; or (d) any content you submit through the Service.


11. Termination

11.1 Termination by You

  • You may delete your account at any time via the Settings page within the Service.
  • For school pilot deployments, the school may request deletion of all school data at any time.

11.2 Termination by Leibniz

We may suspend or terminate your access if you breach these Terms, or if we reasonably determine that your continued use poses a risk to the Service or other users. Where practicable, we will provide notice before termination.

11.3 Effect of Deletion

Deletion follows the process described in Section 7.4. Account deletion triggers comprehensive, cascading removal across all related records — including submissions, grades, progress data, enrolments, and uploaded work.


12. Dispute Resolution

  • These Terms are governed by the laws of New South Wales, Australia.
  • The courts of New South Wales have exclusive jurisdiction over any disputes arising under or in connection with these Terms.
  • Before commencing legal proceedings, the parties agree to attempt to resolve any dispute in good faith through direct negotiation for a period of at least 30 days.

13. Changes to Terms

We may update these Terms from time to time to reflect changes to the Service, legal requirements, or our business practices. When we make material changes:

  • The "Last Updated" date at the top of this page will be revised.
  • For school pilot deployments, the school will be notified of material changes directly.
  • Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

14. Educational Disclaimer

  • Leibniz is a supplementary learning tool designed to support mathematics education. It is not a replacement for classroom instruction, teacher guidance, or professional educational advice.
  • The Service is not intended to be used as a school's primary assessment or record-keeping system.
  • We do not guarantee any specific academic outcomes, grades, or results from use of the Service.
  • AI-generated feedback is provided for educational support purposes and may occasionally contain errors. Users should verify important information with their teachers.

16. Miscellaneous

16.1 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

16.2 Entire Agreement

These Terms, together with the Privacy Policy and any applicable school pilot agreement, constitute the entire agreement between you and Leibniz regarding the Service and supersede all prior agreements and understandings.

16.3 Waiver

The failure of Leibniz to enforce any right or provision of these Terms will not be deemed a waiver of that right or provision.

16.4 Assignment

You may not assign or transfer these Terms, or any rights or obligations under them, without our prior written consent. Leibniz may assign these Terms in connection with a merger, acquisition, or sale of all or substantially all of its assets.


By using Leibniz, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
